Please be aware of the fact that: the procurement of FM-Broadcast Services is, given the applicable exemption of article 8 of the procurement Directive 2014/24/EU, excluded from the obligations to procure according to said procurement directive (or any other procurement directive). The NPO is however, obliged to the Dutch taxpayers, to procure its services:
(a) in a transparent way; and
(b) based on best value for money.
Publishing this negotiation procedure in the OJEU contract notices only warrants sufficient transparency but does not imply that, by using the EU contract notices for the purpose of transparency, the applicability of directive 2014/24/EU. The applicable procurement rules are provided for in the document named: Procurement Guideline FM-Broadcast Services in the Netherlands on behalf of the NPO' that is available upon request at: fm-negotiations@npo.nl together with the other procurement documents (RFP FM-Broadcast Services version 0.9 and Draft Contract FM-Broadcast Services version 0.9).
