This tender aims to conclude multiple framework agreements for geophysical and geotechnical surveys for platform locations (work package 1), and routes (work package 2), to be performed during the development and construction of connections.
Surveys for platform locations for TenneT TSO GmbH. during the development/ construction of connections may also fall under this framework agreement. Also, if extended after the first 3 years, surveys for operational connections may also fall under this framework agreement.
Further agreements will be awarded by means of mini-competitions, for which qualified consultants holding a framework agreement will be invited.

Tenderers will be informed of the award decision or any other decisions regarding this tender procedure - such as exclusion of a tenderer, disregard of a tender, or cancellation of the tender procedure - at the earliest possible opportunity.

If tenderers object to this award decision, they must make their objections known within 20 calendar days of the postmarked date of this award decision by serving on TenneT an application for interim measures before the competent preliminary injunctions court. If after these 20 calendar days tenderers initiate legal proceedings in connection with the decision to award the contract, TenneT will adopt the position that they have inadmissible claims. The period of 20 calendar days must therefore be regarded as a time limit.

Tenderers that institute summary legal proceedings are requested to send the TenneT contact person a copy of the draft summons via the messaging module on the Negometrix platform. TenneT has the right to provide a copy of the served summons to stakeholders such as the party or parties awarded the contract.

Provided that summary legal proceedings are instituted in the prescribed way, TenneT will await the outcome of the proceedings before definitively awarding the contract.

TenneT reserves the right to await the outcome of an appeal before possibly awarding the contract definitively.

If TenneT has notified the tenderer awarded the contract of the instituted summary legal proceedings, the tenderer concerned will be required to intervene in the legal proceedings, on penalty of forfeiture of the right to take further action against any amended decision to award the contract.

If a tenderer wishes to institute proceedings in a dispute that is not related to selection for the purpose of the negotiations, the award, or a retender, it must do so no later than 90 calendar days after the dispute arises, but in any event no more than 90 calendar days after the date on which the contract is awarded, unless the dispute is the result of a circumstance which only came to light after expiry of that period and of which the tenderer could not reasonably have been expected to be aware sooner. In the latter case, the period of 90 calendar days will start on the day on which the circumstance in question came to light or on which the tenderer could reasonably have been expected to be aware of the circumstance. The period of 90 calendar days must therefore be regarded as a time limit in this case also.

By submitting a tender the tenderer automatically accepts this tender procedure as well as the tender dossier including the contractual framework, the minimum requirements and the evaluation, scoring and contract awarding methods.
