This procurement exercise will establish a series of EC compliant Framework Agreements for the supply and support of Optical Transmission Equipment (OTE) for the Research and Education Sector in continental Europe. This entails the establishment of flexible contractual vehicles for the supply, support, delivery, installation and commissioning of OTE that is suitable for deployment in research and education networks such as GÉANT and its member NREN networks.
The tender exercise will achieve 2 outcomes:
(a) the establishment of up to 6 Framework Agreements for the supply and support of optical transmission equipment, as described above, to be used by the R&E community, with projected overall values expected to be up to 100 000 000 EUR over the term of the resultant frameworks;
(b) identification of the most economically advantageous tender in respect of the new GÉANT network requirements (for the first series of call-off contracts).
GÉANT's requirements shall be used to test the technical suitability as well as the price competitiveness of the various bidders.
GÉANT intends to structure the frameworks so as to permit call-off contracts to be awarded to suppliers appointed to the frameworks, either by way of direct award without reopening competition or by reopening competition with appointed suppliers.
Generally, GÉANT and participating NRENs would expect to use the direct award procedure (except where the criteria for reopening competition may apply).
For the purpose of direct award, the framework will set out all the terms governing the supply of the equipment in question (including pricing and any discounting arrangements) and the objective criteria for selecting which of the appointed suppliers will be invited to meet particular requirements as outlined below.
Circumstances for direct awards include:
— call-off contracts for individual items or smaller quantities of equipment,
— to supplement or augment equipment currently existing in GÉANT or NREN networks,
— call-off contracts for spare parts or additional components required for increased scale or performance,
— for reasons of interoperability or compatibility with existing systems.
Circumstances where GÉANT or NRENs reserve the right to reopen competition include:
— where new technologies, within the scope of the framework and contract notice, come to market during the term of the framework and are likely to be available from framework suppliers,
— observed market pricing for equipment within the scope of the framework and Contract Notice suggests that lower costs could be achieved by reopening competition taking into account the predetermined price index specified in the Framework Agreement,
— technical issues e.g. a need to compare the costs and capabilities of different network management solutions,
— complex or larger scale requirements.
GÉANT is acting as a CPB and the NRENs listed in the tender documents will be eligible to use the resultant Frameworks for the purchase and associated support of all types of OTE.
