Lot 1: Protection Equipment Netherlands;
Lot 2: Busbar Protection Equipment Germany;
Part a: 80% Volume, Part b: 20% Volume;
Lot 3: Bay Protection Equipment Germany.
Part a: 60% Volume, Part b: 40% Volume.
Training of TenneT staff for performing engineering tasks is to be offered as option.
Installation, System Integration, On-Site Testing and Commissioning is not in the scope.
The tendering process consists of 2 phases:

2: Offer phase with as Call for tender (ITT, RFQ, Initial bid, Negotiation, Best and Final Offer with potential Verification by building a Proof of Concept and optional Factory audit(s), Awarding).

Combinations of all lots 1, 2, and 3 is possible. Note for each of the lots 2 and 3 there will be 2 parties.
Next to single offers per lot, tenderers can also quote a combined offering for combinations of lots in a dedicated letter to the Offer(s). In case then the awarding of the combined lots is more economic advantageous than awarding of the single offers per lot, TenneT reserves the right to award contracts to parties of the most economic advantageous combination of offers.

Candidates will be informed at the earliest possible opportunity about the selection decision or eventually other decisions concerning the selection procedure like exclusion of candidate or revoke of the call for tenders procedure.
If candidates object to this (selection) decision, they must make their objections known to TenneT within 10 days of the postmarked date of the (selection) decision by serving an application for interim measures before the competent preliminary injunctions court at Arnhem. If candidates initiate legal proceedings in connection with the(selection) decision after these 10 days, TenneT will adopt the position that those candidates have inadmissible claims. The period of 10 days must therefore be regarded as a time limit.

Candidates that institute summary legal proceedings are requested to send a copy of the draft summons via the message module on the Negometrix platform and to ask TenneT to provide the unavailability dates of TenneT and its legal counsel in advance. TenneT has the right to provide a copy of the served summons to stakeholders.

Any institution of summary legal proceedings will not oblige TenneT to suspend the call for tenders procedure and TenneT will have the right to continue the call for tenders procedure with the parties it selected.
If TenneT has notified the selected candidates of the instituted summary legal proceedings, the selected candidates will be required to intervene in the legal proceedings, on penalty of forfeiture of the right to take further action against any changes to the intended selection.
