Geschiktheid om de beroepsactiviteit uit te oefenen:

The bidder must enclose recent proof of registration in the Commercial Register or professional register of the country of residence of the bidder or a certificate as referred in article 47, paragraph 1 of the BAO. This evidence must contain up-to-date information.

The evidence must describe the current situation of the company and not be older than six months, counting from the registration closing date.

In the event of a combination:

In the event that the bidder is a combination, each party of the combination must submit such proof of registration individually.

Economische en financiële draagkracht:

If a bidder relies on the economic and financial standing, technical and or professional ability, quality assurance and/or environmental standards of one or more natural persons or legal entities (hereinafter referred to as third parties), e.g. subcontractors, the bidder must demonstrate that he truly has access to the means of those natural persons and legal parties required for the execution of the contract.

To this end, the bidder must submit a statement of that/those third party/parties certifying this, which statement must be co-signed by the bidder. A declaration (of intent) signed by the bidder and the third party/parties showing the above satisfactorily will also be accepted, in model E4.

The requested information with regard to the capacity or competency of the bidder relied upon must of course be enclosed in the manner as requested in chapter 9.

Note: The statement or declaration (of intent) referred to above need not be submitted by parties of a combination.

Technische en professionele bekwaamheid:

The bidder must submit a minimum of three (3) reference project(s) which were completed in the period 2007 - 2012.

Two (2) reference projects must relate to the delivery and installation of a gas fired hot water boiler with an output between 25 and 50 MW, which boilers did meet at least the following requirements:

-Efficiency output ? 93,5%

-NOx output ? 70 mg/NM3

One (1) of the reference projects must relate to the construction of civil / structural works and the delivery and installation of a process installation under the sole responsibility or coordination of the bidder. If the bidder was the coordinating party he must have been responsible for the planning of the works and the interface planning between the civil works and the process installation.

The description of the reference projects have to be submitted in accordance with the model E14.

If a bidder who has not been selected for the awarding of the tender, respectively a rejected bidder holds the opinion that the decision taken is contrary to the law or other applicable legal regulations, he shall, no later than 15 calendar days after the notification of the aforementioned decision has been sent, inform us, in writing and stating his reasons, that he shall take recourse to a legal remedy, and attach the copy of the writ of summons. Legally suing the awarding department shall not work as suspension of the tender procedure. The aforementioned term shall commence on the day after the date of the notification in writing that the bidder has not been selected and ends on the fifteenth day at 17.00 PM.
