This tender concerns the supply of the key medical equipment for PTCG b.v., Proton Therapy Center Groningen. This is one of the main contracts in connection with PTCG b.v.
The Project, known as the Proton Therapy Center Groningen (PTCG) will consist of two treatment rooms that should provide a total capacity of 600 patients per year. PTCG will incorporate a minimum 20 calendar day standstill period at the point information on the award of the contract is communicated to the Tenderers. The purpose of the standstill period referred to above is to allow parties to apply to the courts to set aside the award decision before the contract is awarded. In this event, the Tenderer should notify PTCG of his intention, in writing and stating full details, within 20 days of the date stated in the letter of notification, and should enclose the (pro forma) summons. By submitting a Tender, all Tenderers expressly accept this 20-day limitation. All such disputes are to be placed before the District Court of Groningen, Netherlands, having sole jurisdiction in all matters relating to the Tender procedure. In principle, the commencement of legal proceedings will not result in the suspension of (the remainder of) the tendering procedure.
