NV Nederlandse Gasunie

A framework agreement that sets out the terms and conditions under which specific purchases (“call off’s”) can be made by Gasunie throughout the term of the agreement for the delivery of calibrated turbine meters for fiscal measuring purposes, fully compliant with the [technical] requirements set forth in the tender documents under this call for tender. It is the objective of Gasunie to ultimately have "smart" meters delivered; that is calibrated turbine meters that are developed and manufactured in such way that they are "future proof"; allowing for a non complicated, "easy" replacement of the metrologic part of the meter, to be substituted by a new metrologic meter with features allowing for remote monitoring.

Geschiktheid om de beroepsactiviteit uit te oefenen:

a) The Candidate shall have an authorised managing director (therefore no holder of a power of attorney) sign a statement in accordance with the model attached, stating that the reasons for exclusion, as referred to in article 45 BAO do not apply to the candidate;

b) The candidate shall enclose a recent certificate of registration in the commercial or professional register of the country of incorporation or a certificate as referred to in article 47 paragraph1 BAO. The certificate shall have to contain his current information;

c) The candidate shall submit a statement that the executive management staff is competent in either the English or the Dutch language, verbally as well as in writing, and that the written correspondence can take place in either the English or the Dutch language;

d) If the candidate forms part of a holding/group of companies, he shall include an organization chart of the structure of the holding/group of companies, including the name, address and registered office of the group of companies.

Technische en professionele bekwaamheid:

The candidate shall submit a statement in which he declares that he is able to deliver at least 150 (one hundred fifty) Calibrated turbine meters per year in varying diameters (project related). Furthermore, the candidate shall give a description of the capacity and facilities he uses for the aforementioned delivery of 150 calibrated turbine meters per year.

Only one legal entity from a group of companies can apply as a candidate. However, more legal entities from a group of companies can apply only jointly as candidate in the form of a combination. "group of companies" is taken to mean a legal entity with its subsidiary companies in the meaning of article 24a, book 2, Civil Code of the Netherlands. If the application takes place in contravention of the aforementioned, only the application of the candidate which was submitted first shall be handled.

Informatie over termijnen voor beroep:

If a candidate who has not been selected in the selection process or the awarding of tender, respectively a rejected candidate holds the opinion that the decision taken is contrary to the law or other applicable legal regulations, he shall, no later than 15 calendar days after the notification of the aforementioned decision has been sent, inform Gasunie in writing - stating his reasons - that he shall take recourse to a legal remedy. The copy of the writ of summons shall be attached to such notification send to Gasunie. The deposition of a claim with / against Gasunie shall not cause or result in a suspension of the tender procedure (unless and until so ordered by the relevant court). The aforementioned term applicable to objections / a claim on the part of a candidate, shall commence on the day that follows the date of dispatch of the notification in writing to that candidate that he has not been selected. This term ends on the fifteenth day at 5 PM.
